		<description><![CDATA[Amnesty International has called on Nepalrsquo;s government to immediately fix the flawed vetting process that allowed an army major charged with murder to participate in the United Nations peace keeping mission in the Central African Republic. br /

Major Niranjan Basnet is charged with murdering 15-year-old Maina Sunuwar on 17 February 2004. She died in military custody after she was subjected to electrocution and drowning during interrogation. Her body was later exhumed from an army barracks where Nepali UN peacekeepers are trained. br /
br /
In a letter to Prime Minister Madhav Kumar Nepal the organization said the inclusion of Major Basnet in the peace keeping force revealed serious shortcomings in the vetting of troops from the Nepal Army to UN missions that could put civilians at risk in countries where they are deployed. br /
br /
ldquo;The Nepali government has failed to provide accountability for the many atrocities committed by Nepali security forces as well as Maoist cadres during Nepalrsquo;s civil war. The resulting culture of impunity undermines the rights of victims and their families, and potentially carries over to the Armyrsquo;s involvement in UN missions and threatens the rights of those they have been assigned by the United Nations to protect,rdquo; said Sam Zarifi, Amnesty Internationalrsquo;s Asia Pacific Director. br /

Amnesty International urged Nepalrsquo;s government to re-assess every member of the Nepal Army currently participating in UN missions to ensure that they are not implicated in serious human rights violations. br /
br /
Major Basnet was recently expelled from the United Nations Mission in Chad because of his human rights record and repatriated to Nepal, but the Army has so far refused to hand him over to the civilian authorities. br /
br /
ldquo;The Nepali army is shielding Major Basnet from serious and credible allegations; he should be immediately surrendered to a civilian court for trial. The ongoing failure to address his case properly casts serious doubt on the Nepali governmentrsquo;s commitment to international human rights standards and the fitness of Nepali forces to serve as UN peacekeepers,rdquo; said Sam Zarifi. br /

In a separate letter to the United Nations Under-Secretary-General of the Department of Peacekeeping Operations, Amnesty International welcomed the United Nations decision to expel and repatriate Major Basnet and called on the United Nations to insist that the government of Nepal review the troops it contributes to UN peacekeeping. br /

ldquo;Nepali troops have played a very important role in UN peacekeeping around the world. The Nepali government should work closely with the UN to ensure no Nepali troops accused of human rights violations are deployed as UN peacekeepers,rdquo; said Sam Zarifi. br /

Amnesty International repeated its call for the government to ensure that Major Basnet is arrested without further delay and transferred to the civilian courts for trial. br /

The organization also called for all outstanding allegations of crimes committed by the Army, the police and Maoist forces to be investigated and, where there is sufficient admissible evidence, prosecuted by competent, independent and impartial civilian courts.nbsp;]]></description>

		<description><![CDATA[The Nepali government must ensure that an army major accused of torturing a 15-year-old Nepalese girl, to death, is arrested immediately and transferred to a civilian court for trial, Amnesty International said on Monday.br /

Major Niranjan Basnet was expelled from a UN peacekeeping mission in Chad, after it emerged that the Kavre District Court had charged him with the 2004 murder of the 15-year-old girl, Maina Sunuwar. br /
br /
Major Basnet was returned to Nepal on Saturday. Despite the Prime Minister's instructions that he be arrested at the airport and transferred to the court, military police are reported to have escorted him from the airport to the Army Headquarters in Kathmandu.br /
br /
Maina Sunuwar died in military custody on 17 February 2004, after she was subjected to electrocution and drowning during interrogation. Her body was later exhumed from an army barracks where Nepali UN peacekeepers are trained.br /
br /
According to media reports, the Minister of Defence is opposed to arresting and surrendering Major Basnet to a civilian court.br /
br /
Reports also indicate that senior Army staff are waiting for Army Chief Chhatra Man Singh Gurung to return from a visit to India to make a decision on whether the Army will cooperate with the civilian prosecution. He is due to return on 19 December.br /
br /
quot;This is a key moment for the Nepalese Army to demonstrate its commitment to human rights and to ending impunity,quot; said Jonathan Orsquo;Donohue, of Amnesty International's International Justice Programme.br /

quot;Refusal to cooperate with the arrest of Major Basnet and to hand him over to the authorities immediately will send a clear message to the people of Nepal and the international community that there is no accountability for thousands of killings, torture and disappearances committed by the Nepal Army in recent years.quot;br /

Amnesty International rejects arguments by army personnel that Major Basnet was given a quot;clean chitquot; by a Military Court of Inquiry into Maina's murder in 2005 and cannot be prosecuted by the civilian court. br /
br /
The organization said that by defining the severe torture that Maina Sunuwar was subjected to as quot;carelessnessquot; the Military Court demonstrated that its investigation and prosecution of her case were neither independent nor impartial.br /
br /
Independent investigations conducted by the civilian authorities have determined that there is sufficient evidence to charge Major Basnet with Maina's murder. Those charges exist independent of the findings of any Army investigation.br /
br /
Instead of ensuring Major Basnet's arrest and prosecution, the Nepal Army allowed him to continue performing his duties and has so far failed to cooperate with the civilian investigations.nbsp; br /

Instead of ensuring Major Basnetrsquo;s arrest and prosecution, the Nepal Army allowed him to continue performing his duties (contrary to the Army Act) and has so far failed to cooperate with the civilian investigations.nbsp; nbsp;br /
br /
Last week it emerged that he was participating in the United Nations Peacekeeping Mission in Chad. The United Nations has now reportedly instructed the Government of Nepal to repatriate him. br /
In 2008, Major Basnet was one of four soldiers charged by the Kavre District Court with Maina Sunuwarrsquo;s killing.nbsp; All four remain at large. br /
br /
A military court convicted the other three soldiers in 2005, but only on minor charges following a ruling that her death was the result of ldquo;carelessnessrdquo; as opposed to deliberate torture. They received sentences of only six months in prison which they did not serve, as the military court counted the time they spent confined to barracks during the investigation. br /
br /
ldquo;We have serious concerns that these military proceedings were neither independent nor impartial.rdquo; said Jonathan Orsquo;Donohue, of Amnesty Internationalrsquo;s International Justice Program. br /
br /
ldquo;Major Basnet must be prosecuted by a civilian court for his alleged involvement in Maina Sunuwarrsquo;s murder. If he is still in Chad, the Nepal government should request the UN Mission to detain him and to ensure his transfer back to Nepal to face trial. rdquo;nbsp; Jonathan Orsquo;Donohue said. br /

This case represents only one of hundreds of killings, enforced disappearances and torture committed by the Nepal Army, which the government and the military continue to ignore. br /
br /
ldquo;All human rights violations committed by soldiers and others must be investigated and, where there is sufficient evidence, those responsible prosecuted in civilian courts,ldquo; saidnbsp; Jonathan Orsquo;Donohue. br /
br /
ldquo;Victims and their families must receive justice. The truth about what happened to them or their loved ones must be made known and full reparations should be provided.rdquo; br /
br /
Major Basnet had passed internal Nepali military vetting procedures on human rights before he was assigned to the UN peacekeeping mission. br /
br /
ldquo;Disturbingly, given that impunity in Nepal is pervasive, it is likely that - without an effective system of vetting in place - many other perpetrators of such serious human rights violations may now be serving in UN missions to protect civilians,rdquo; said Jonathan Orsquo;Donohue. br /

For years, the Nepali Army tried to conceal the truth about what happened to Maina Sunuwar and the whereabouts of her remains from her family. br /
br /
Following national and international pressure, the Army conducted flawed military investigations and military court proceedings against three of those accused. Though Major Basnetrsquo;s name featured prominently in the report of the armyrsquo;s internal investigation team, he was not charged at that stage. br /
br /
Although the military court recognized that Maina Sunuwar had been subjected to drowning and electrocution during interrogation, it ruled that her killing was not the ldquo;result of intentional severe torture but [that she] died unfortunately and accidentally due to wrongful techniques used out of carelessness, fickleness and irrationality during the interrogation and due to her own physical weaknesses.rdquo; br /
br /
The three soldiers were convicted of only minor offences, such as using improper interrogation techniques and not following procedures. br /
br /
In September 2009, the Kavre court ordered the suspension of Major Basnet from the military.]]></description>
